New Drone Regulations Fly Onto the Scene

New drone regulations take effect

The dust is still settling around drone technology and its regulation by the Federal Aviation Administration. Beginning August 29, 2016, the new Small Unmanned Aircraft Rule (Part 107) will be in effect – creating additional safety rules for drones. Staying up-to-date on these drone regulation rules is crucial for all parties involved in the drone photography practice.

These new drone regulations include but are not limited to:

  • Unmanned aircraft must weigh less than 55 pounds
  • Daylight-only operations – meaning that drones are to be operated from 30 minutes before civil twilight to 30 minutes after official sunset
  • Maximum groundspeed cannot exceed 100 mph
  • Weather visibility must be at least 3 miles from drone controller
  • No operations from a moving aircraft
  • No operations from a moving vehicle unless the vehicle is in an isolated area
  • No carriage of hazardous materials
  • No operation of drone of operator feels either mentally or physically impaired to do so in any way
  • Operator of drone must either hold a remote pilot airman certification or be under the direct supervision of a person who holds a remote pilot certification
  • The operator must have visual line-of-sight with the drone, they must be capable of seeing the aircraft with vision unaided by any device other than corrective lenses
  • Maximum altitude of 400 feet above the ground. If above 400 feet, drone must remain within 400 feet of a structure
  • First-person view cameras cannot satisfy the “see-and-avoid” requirements but can still be used as long as the requirement is satisfied in other ways
